4. Ordering, Payment Terms, and Pricing
4.1 Order Placement
When you place an order through our Site or other authorized channels, you are making an offer to purchase the selected Food Products at the stated price. An order confirmation does not constitute final acceptance; we reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or description, or suspected fraud. In the event we cancel a confirmed order, we will provide a full refund using the original payment method.
4.2 Pricing
All prices listed on our Site are in United States Dollars (USD) and are subject to applicable sales tax as required by applicable state and local law. Prices may vary by location and are subject to change without notice. Any promotional pricing or discounts are subject to specific terms and conditions and may have expiration dates or other limitations.
4.3 Payment Methods
We accept major credit cards (Visa, Mastercard, American Express, Discover), debit cards, and other payment methods as indicated on the Site. By providing payment information, you represent and warrant that: (a) the payment information is accurate and complete; (b) you are authorized to use the payment method; and (c) your use of the payment method does not violate any applicable law or agreement. 4.4 Taxes
You are responsible for paying all applicable federal, state, and local taxes associated with your purchase. We will collect applicable sales tax at the point of sale as required by law.
4.5 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final. Refunds or replacements may be issued at our sole discretion in cases where: (a) you received an incorrect order; (b) the food item was of unsatisfactory quality; or (c) your order was not delivered. Requests for refunds must be made within twenty-four (24) hours of the order. We reserve the right to offer a replacement order, store credit, or refund as appropriate in each situation. Catering orders may be subject to separate cancellation and refund policies as outlined in any catering agreement.
4.6 Third-Party Delivery Platforms
If you place an order through a third-party delivery platform (such as DoorDash, Uber Eats, Grubhub, or similar services), those orders are subject to the terms and conditions of the respective third-party platform. Anthony's Coal Fired Pizza is not responsible for any issues arising from the use of third-party delivery platforms, including delivery delays, service outages, or pricing discrepancies.
5. Intellectual Property Rights
5.1 Ownership
The Site and all of its content, features, and functionality — including but not limited to text, graphics, logos, images, photographs, menu designs, videos, audio files, software, and the arrangement thereof — are the exclusive property of Anthony's Coal Fired Pizza or its licensors and are protected by United States and international copyright, trademark, trade dress, patent, and other intellectual property laws.
5.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site solely for your personal, non-commercial use of our services. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.
5.4 User-Submitted Content
If you submit, post, or otherwise provide any content to us — including reviews, feedback, photographs, or suggestions ("User Content") — you grant Anthony's Coal Fired Pizza a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media for any purpose related to our business. You represent and warrant that you own or have the necessary rights to grant this license and that the User Content does not infringe any third-party rights.
6. Food Allergen and Nutritional Disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANTHONY'S COAL FIRED PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
7.2 No Warranty of Accuracy
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site, including menu descriptions, pricing, availability, nutritional information, or hours of operation. We reserve the right to correct any errors or omissions and to update or change information at any time without notice.

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES FEDERAL AND STATE LAW, IN NO EVENT SHALL ANTHONY'S COAL FIRED PIZZA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, OUR SERVICES, OR OUR FOOD PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ANTHONY'S COAL FIRED PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SITE, SERVICES, OR FOOD PRODUCTS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO ANTHONY'S COAL FIRED PIZZA IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or consequential damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
The limitations of liability set forth in this Section are fundamental elements of the basis of the bargain between Anthony's Coal Fired Pizza and you. Anthony's Coal Fired Pizza would not be able to provide the Site and services on an economically reasonable basis without these limitations.
9. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Anthony's Coal Fired Pizza and its owners, officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) that arise from or relate to:
- Your use of or access to the Site or our services;
- Your violation of these Terms or any applicable law or regulation;
- Your violation of any third-party rights, including intellectual property rights or privacy rights;
- Any User Content submitted by you;
- Your negligence, willful misconduct, or fraud;
- Any dispute between you and any third party arising from or related to your use of our services.
We reserve the right, at your expense, to assume exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any such matter without our prior written consent. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Anthony's Coal Fired Pizza's principal place of business is located, without regard to its conflict of law provisions. The Federal Arbitration Act governs the interpretation and enforcement of the dispute resolution provisions set forth herein.
Subject to the arbitration agreement set forth in Section 11, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located within the United States for the resolution of any disputes not subject to arbitration. You hereby waive any objection to jurisdiction or venue in such courts.
These Terms are subject to applicable federal laws, including the Federal Trade Commission Act (FTC Act), which governs unfair or deceptive acts or practices in or affecting commerce. To the extent applicable, we also comply with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) for customers in California, as well as other applicable state consumer protection statutes.
If you are a consumer residing in a state that provides additional rights or protections under consumer protection laws, nothing in these Terms is intended to limit or waive those rights to the extent they cannot be waived by contract under applicable law.
11. Dispute Resolution and Arbitration
11.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or related to these Terms, our Site, our services, or our Food Products ("Dispute") informally by contacting us at [email protected] with a written description of the Dispute, your name, and contact information. We will attempt to resolve the Dispute informally within thirty (30) days of receiving your notice. If the Dispute is not resolved within thirty (30) days, either party may proceed to binding arbitration as described below.
11.2 Binding Arbitration
EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT AND EXCEPT AS OTHERWISE PROVIDED HEREIN, YOU AND ANTHONY'S COAL FIRED PIZZA AGREE THAT ANY AND ALL DISPUTES SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT. The arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in the county where our principal place of business is located, or at another mutually agreed-upon location, or may be conducted by telephone or videoconference at either party's request.
11.3 Class Action Waiver
YOU AND ANTHONY'S COAL FIRED PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both you and Anthony's Coal Fired Pizza each waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration.
11.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction. Additionally, each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of that party's intellectual property rights.
11.5 Arbitration Fees
The allocation of arbitration fees shall be governed by the AAA Consumer Arbitration Rules. If you are a consumer, we will pay all AAA filing, administration, and arbitrator fees for any arbitration we initiate. For arbitration you initiate, fee allocation will be as provided in the AAA Consumer Arbitration Rules.
12. Term and Termination
These Terms shall remain in full force and effect for as long as you use the Site or our services. We reserve the right, in our sole discretion, to:
- Suspend or terminate your access to the Site or any portion thereof at any time, with or without notice;
- Cancel any pending orders in the event of termination for cause;
- Remove or disable any User Content that violates these Terms or that we deem objectionable for any reason.
You may terminate your account at any time by contacting us at [email protected]. Upon termination of your account, your right to use the Site and services will immediately cease. All provisions of these Terms that by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability — shall survive termination.
We shall not be liable to you or any third party for any termination of your access to the Site or services, including cancellation of any orders placed before termination (subject to our refund policy in Section 4.5).

In the event of a Force Majeure Event, we will make reasonable efforts to notify you and to resume normal operations as soon as practicable.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements expressly incorporated by reference herein, constitute the entire agreement between you and Anthony's Coal Fired Pizza with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to such subject matter. No waiver of any provision of these Terms by Anthony's Coal Fired Pizza shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
19. Severability
If any provision of these Terms is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or in conflict with any applicable law, the remaining provisions of these Terms shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.
In particular, if the class action waiver in Section 11.3 is found to be invalid or unenforceable with respect to a particular claim, then the arbitration agreement in Section 11.2 shall not apply to that claim, and such claim shall be resolved in a court of competent jurisdiction.
20. Waiver
No failure or delay by Anthony's Coal Fired Pizza in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, remedy, power, or privilege by Anthony's Coal Fired Pizza shall preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege. The rights and remedies provided in these Terms are cumulative and not exclusive of any rights or remedies provided by law.
21. Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this Section shall be null and void. Anthony's Coal Fired Pizza may freely assign or transfer its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law. These Terms shall be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.
22. No Third-Party Beneficiaries
These Terms are for the sole benefit of you and Anthony's Coal Fired Pizza and do not create any third-party beneficiary rights. Nothing in these Terms, express or implied, is intended to or shall confer upon any other person or entity any legal or equitable right, benefit, or remedy of any nature whatsoever under or by reason of these Terms.
